Terms of Service

1. Acceptance of Terms

By accessing or using Bracket Breeze (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the Platform, including tournament promoters (“Promoters”) and players (“Players”). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

Bracket Breeze is a multi-tenant SaaS platform that enables sports tournament organizers to create and manage events, and enables players to discover, register for, and participate in those events. Bracket Breeze is not itself a tournament organizer or event venue — it provides software infrastructure to independent Promoters.

3. Accounts

You must create an account to use certain features of the Platform. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate, complete, and current information when registering. You must be at least 13 years old to create an account.

4. Promoter Terms

If you use Bracket Breeze as a Promoter, you additionally agree to:

  • Provide accurate event information and fulfill your obligations to registered participants.
  • Connect a Stripe account and comply with Stripe's Connected Account Agreement.
  • Be solely responsible for the events you create, including participant safety, cancellations, and refunds.
  • Not use the Platform for unlawful purposes or to defraud participants.
  • Ensure that any waivers or participant agreements you require comply with applicable law.

5. SMS Communications

By providing a mobile phone number during signup and completing SMS verification, you opt in to receive transactional text messages from Bracket Breeze, including account verification codes, event reminders, check-in notices, schedule changes, and roster updates for events you register for. Message frequency varies; message and data rates may apply. Reply STOP at any time to unsubscribe, or HELP for assistance. We do not sell or share your phone number or SMS opt-in data with third parties for their marketing. See our Privacy Policy for full details.

6. Payments and Fees

Registration fees for events are set by each Promoter. When a Player registers for an event, payment is processed through Stripe and flows directly to the Promoter's connected Stripe account, minus applicable Stripe processing fees and a platform fee retained by Bracket Breeze. Bracket Breeze is not a party to the payment transaction between Player and Promoter.

Refund eligibility is determined by each Promoter's refund policy for the specific event. Bracket Breeze may assist in processing refunds but is not obligated to issue refunds on behalf of Promoters.

7. Assumption of Risk

Sports activities involve inherent physical risks. By registering for an event through the Platform, Players acknowledge and accept those risks. Bracket Breeze is a software platform only and is not responsible for injuries, accidents, or incidents that occur during events organized by independent Promoters.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws.
  • Impersonate any person or entity, or falsely represent your affiliation.
  • Attempt to gain unauthorized access to any part of the Platform or its systems.
  • Scrape, crawl, or otherwise extract data from the Platform without written permission.
  • Interfere with or disrupt the integrity or performance of the Platform.

9. Intellectual Property

The Bracket Breeze name, logo, and Platform software are the property of Bracket Breeze. You may not use our trademarks or copy our software without written permission. Content you submit (event descriptions, logos, images) remains yours; you grant Bracket Breeze a license to display it on the Platform.

10. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. BRACKET BREEZE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRACKET BREEZE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO BRACKET BREEZE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may close your account at any time by contacting us. Termination does not relieve you of obligations incurred prior to termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts located in Tennessee.
